                             STATEMENT OF JURISDICTION

 

          The Common Law Court of the United States of America has jurisdiction founded upon the fact that the declaratory relief is for citizenship in the United States of America.

 

STATEMENT OF ISSUES PRESENTED FOR REVIEW

 

The petitioner is abrogating citizenship in the United States by declaring allegiance to the laws of the United States of America.

 

          The petitioner is making a choice of law decision by submitting to the laws of the United States of America.

 

STATEMENT OF THE CASE

The petitioner is a United States citizen who intends to acquire a new domicile in the Commonwealth of the United States of America.   The petitioner is taking the following steps:

1.  Filing a declaration of allegiance to the laws of the United States of America herein.

2. Filing a copy of birth certificate as evidence of status and birth in the United States.

3.  Petitioning this court for declaratory relief.

4.  Prosecuting said declaration in the United States Court of Federal Claims.

 


 

                                      SUMMARY OF EVIDENCE

          The petitioner is qualified under existing laws of the United States of America to acquire citizenship and/or domicile.

 

                                                AUTHORITIES

          The writ is protected by Article 1, Section 9, Clause 2 of the Constitution which states;

         

          “The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”

 

          United States law authorizes the voluntary loss of nationality in Title 8

U.S.C. § 1481(a)(2) which provides in part:

 

          “A person who is a national of the United States ...shall lose his nationality by voluntarily performing any of the following act with the intention of relinquishing United States nationality–

          (2) taking an oath or make an affirmation or other formal declaration of allegiance to a foreign state...after having attained the age of eighteen years;”

 

          United States law provides for suits in Commonwealth Courts in Title 48 U.S.C. § 1493 which states in part:

 

“The prosecution in a territory or Commonwealth is authorized - unless precluded by local law - to seek... suitable relief in the appropriate local ...court...”

 

 

          The Congress of the United States has provided for full faith and credit to the Commonwealth Court in Title 28 U.S.C. § 1652 which provides in part:

         

          “The laws of the several states, except where the Constitution or treaties of the United States or Act of Congress otherwise require or provide, shall be regarded as rules of decision in civil actions...”

 

And Title 28 U.S.C. § 1746(1) also provides a method of verifying said claims under the laws of the Commonwealth of the United States of America.

 

“If executed without the United States: I declare....under penalty of perjury under the laws of the United States of America...”

         

CONCLUSION

 

          The relief being requested is a Writ of Repatriation to reclaim the ancient domicile of the petitioners race.  The petitioner is making a choice of law decision.  The choice of law is the Common law of the Commonwealth of the United States of America.
